Trademark Violation

A famous fashion house has a registered trademark on a check pattern in camel, black and red. It argued that a hypermarket chain sold duvets that violated its trademark. The fashion house asked for trademark violation damages.

Lawsuits With Collective Management Organisations

Any company playing music in a public place must pay a fee to public organisations managing copyrights. Oftentimes companies find the fee amount to be too high or believe they should not pay it at all. I have defended festival organizers, hotel companies, ride-sharing apps, carriers in such lawsuits.

Lawsuits Between Individuals and Banks

Since 2015 there have been a lot of lawsuits in Romania between banks and individuals with Swiss francs loans. I have defended banks in over 100 lawsuits in which consumers challenged contractual terms. I gained a deep understanding of when certain clauses can be annulled for being unfair. Contractual terms can be found unfair in any lawsuit filed by a consumer whether against banks, airlines, phone companies or bookmakers.

Lawsuits Between Taxi Companies and Ride-Sharing Apps

Since 2016 taxi companies have had to deal with new competitors: ride-sharing apps. In several cities across Romania taxi companies filed lawsuits against them and asked for such apps to be banned. They argued that the apps engaged in unfair competition because they provided transportation services without a license. I defended a well-known such app in several cases in Cluj, Bucharest and Timisoara.

Denigration in Relation to an Auction

An auction house advertised that it was organizing an auction with some of composer George Enescu’s personal belongings. My client, a public institution under the Ministry of Culture, issued a press release regarding this auction. It expressed concern over the authenticity of two items. The auction house requested that the statement be removed until the auction took place. It argued that it was denigrating and would lower the price of the items.

Property Violation

A real-estate developer and telecom service provider built a residential complex. Although it sold this residential complex, it kept a strip of land surrounding the complex in such a way that no other telecom company could reach the complex without passing through the developer’s property. The developer filed a lawsuit against my client and demanded the removal of the telecommunications network built by the client because it allegedly violated its property.

Recovery of Expenses Without a Contract in Place

My clients helped an elderly person in need by taking care of her and refurbishing her run-down apartment. My clients agreed over the phone with a relative of hers who lived abroad that these expenses would be settled later. However, they did not sign a contract. After the elderly person died, the relative refused to pay my clients although she had inherited the entire estate.
